Palm Beach Dumpsters & Trash Removal, Inc.

Important: These Terms of Service (“Terms,” “Agreement”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Palm Beach Dumpsters & Trash Removal, Inc. (“Palm Beach Dumpsters,” “PBD,” “Company,” “we,” “our,” or “us”) governing your access to and use of (1) our website located at pbdumpsterstr.com and its sub-pages (collectively, the “Site”), and (2) all related products, software, mobile features, quote forms, and dumpster rental and waste-removal services we provide (collectively, the “Services”).
By accessing the Site, submitting a quote request, booking a dumpster, paying an invoice, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site or the Services.

1. Definitions

“Customer Content” – All instructions, details, materials, and other content that you submit or make available to us (e.g., delivery placement notes, property photos).
“Dumpster” – Any waste container, bin, roll-off box, trailer, or similar receptacle we provide for the temporary collection and removal of waste.
“Prohibited Materials” – Items that federal, state, or local law or our disposal partners prohibit from being placed in a Dumpster (e.g., hazardous chemicals, tires, medical waste, batteries, asbestos).
“Service Area” – The geographic regions in which PBD offers delivery and pickup, currently all of Palm Beach County and selected surrounding areas in South Florida.
“Order” or “Booking” – A confirmed request by you for a Dumpster rental, whether made by phone, online quote form, email, or other method we accept.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use our Services. By placing an Order, you represent and warrant that you meet these eligibility requirements.

3. Quote Requests and Bookings

Quote Form Submission – You may request a price estimate by completing the “Get a Quote” form on our Site. Quotes are free and do not obligate you to book.
Accuracy of Information – You agree to provide true, current, and complete information, including your name, phone, email, delivery address or ZIP code, project type, preferred delivery date, and any special instructions.
Estimate vs. Final Charges – Quotes are estimates based on the information you provide. Final charges may vary due to actual delivery distance, weight overage, prohibited materials, extended rental period, or additional pickup attempts.
Booking Confirmation – An Order is not confirmed until you (a) accept the quote (verbally or in writing), (b) provide a valid payment method, and (c) receive an Order confirmation from us by phone, text, or email.

4. Pricing and Payment

Accepted Payment Methods – We accept major credit cards, ACH, and other methods agreed upon in advance. All payments are processed through secure, PCI-compliant gateways.
Due Dates – Unless we agree otherwise, rental fees are charged in full at the time of booking. Additional fees (e.g., overweight charges) are invoiced upon final disposal and payable within 7 days.
Taxes & Government Fees – You are responsible for any sales tax, environmental fee, permit cost, or similar surcharge required by law.
Late Payments – Balances overdue by more than 15 days are subject to a finance charge of 1.5% per month (18% APR) or the maximum rate allowed by law, whichever is less.

5. Delivery & Placement

Site Access – You must ensure unobstructed access for delivery and pickup. Driveways and pathways must support the weight of a commercial truck and loaded Dumpster (up to 20,000 lbs).
Permits – If municipal or HOA permits are required for street or right-of-way placement, you are responsible for obtaining them unless you have arranged in writing for us to do so on your behalf.
Damage Disclaimer – While we take reasonable care, we are not liable for cosmetic damage to pavement, lawns, landscaping, or underground utilities due to weight stress, except where caused by our gross negligence.

6. Use of the Dumpster

Acceptable Waste – Ordinary household junk, construction debris, yard waste, furniture, drywall, wood, roofing shingles, and similar inert materials.
Prohibited Materials – Paints, solvents, oils, chemicals, batteries, tires, asbestos, propane tanks, medical waste, appliances containing refrigerant, liquids, or any item classified as hazardous by federal, state, or local law. You are liable for all costs, penalties, and fines resulting from prohibited materials discovered in your Dumpster.
Fill Level – Do not load materials above the top rim. Overfilled Dumpsters may be refused pickup and subject to trip fees.
Weight Limits – Each Dumpster size includes a weight allowance (e.g., 2 tons for a 10-yard). Loads exceeding the allowance will incur disposal overage fees billed by the ton.

7. Rental Period, Pickup & Extensions

Standard Rental Period – Unless noted otherwise on your invoice, standard rentals are 7 days.
Early Pickup – Contact us at least 24 hours in advance. No early pickup fee.
Automatic Pickup – We automatically schedule pickup on or after the last rental day unless you request an extension.
Extensions – Subject to availability and additional daily fees. You must request extensions before the original rental expires.
Unable-to-Pickup Fee – If we cannot retrieve the Dumpster due to blocked access or overfill, a return-trip fee applies.

8. Cancellations & Refunds

No-Fee Window – Cancel up to 24 hours before scheduled delivery for a full refund.
Late Cancellation – Cancellations made within 24 hours of delivery time incur a flat $75 logistics fee.
Weather Delays – Severe weather may delay delivery or pickup. We will notify you and reschedule at no extra charge.

9. Intellectual Property

All content on the Site, including logos, graphics, text, images, and software, is the property of PBD or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or exploit any part of the Site without our prior written consent.

10. Disclaimers & Limitation of Liability

Services “As-Is” – We provide the Site and Services on an “as-is” and “as-available” basis without warranties of any kind, express or implied.
No Indirect Damages – To the fullest extent permitted by law, PBD shall not be liable for any indirect, incidental, special, consequential, or exemplary damages (including lost profits, loss of data, or goodwill).
Total Liability Cap – Our aggregate liability arising out of or relating to these Terms or the Services shall not exceed the total amount you paid us for the rental giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Palm Beach Dumpsters, its affiliates, directors, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising from your (a) breach of these Terms, (b) violation of any law or regulation, or (c) placement of prohibited materials in a Dumpster.

12. Privacy & Analytics

We respect your privacy. We collect only the information necessary to process bookings and improve website performance.

Analytics Tools Used: Google Analytics, Google Search Console, Bing Webmaster Tools, Microsoft Clarity.
These tools gather non-identifiable usage data (e.g., page views, click events) to help us enhance user experience. We do not sell, rent, or trade your personal information.

13. Termination

We may terminate or suspend your access to the Site or cancel any Order if you violate these Terms or applicable laws. Termination does not relieve you of outstanding payment obligations or liability for prohibited items placed in the Dumpster.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction and venue in those courts.

15. Changes to Terms

We may modify these Terms at any time. When we do, we will revise the “Effective Date” at the top of this page. Continued use of the Site or Services after changes constitutes acceptance of the updated Terms.
